Initial compensation for each of the passengers of the Airbus A320 of Germanwings which crashed Tuesday in the French Alps will be 316.882 euros, according to fixed the regulation 785/2004 of the European Parliament and of the Council of 21 April 2004 on insurance for air carriers and aircraft operators requirements. As insurance subsidiary of Lufthansa, Allianz Global Corporate will assume compensation, even though it has eluded advance details about compensation.
The law provides that “within the framework of the common transport policy, it is important to ensure a proper minimum level of insurance to cover liability of air carriers with respect to passengers, baggage, cargo and third parties”.
In this sense, States that with respect to the liability for passengers, the minimum insurance coverage that has to have the airline will be 250,000 special drawing rights for each.
Special drawing rights is an international currency reserve asset defined and maintained by the International Monetary Fund (IMF) which currently amounts to 0,788 euros. Baggage and cargo
Aside to passengers, the airline also has coverage for luggage, which will be a minimum of 1,131 special drawing rights (1.435,3 euros) per passenger. Charge, the minimum compensation will be 19 special drawing rights (24,11 EUR) in business operations, according to the Regulation 285/2010 of the Commission of 6 April 2010.
The amount of this compensation will vary depending on the personal circumstances of each passenger, such as age or family.
Beyond compensation for passenger, baggage and cargo airline, the relatives of the victims, offering check personal insurance which had hired each affected. In this sense, Pereira pointed out that there is a record in the Ministry of Justice, in which you could see each person’s life insurance.
